How to Search Mercer Civil Dockets
Circuit civil cases open to the public live in the West Virginia Public Access Search System. It is known as WVPASS. Enter through the Judiciary Court Record Access gateway and pick the Circuit Court route. Registration is free. After signing up, you can search by party name, case number, attorney, county, case type, status, and paired date filters. Browsing case details costs nothing.
Magistrate civil claims run through MCRSearch instead. It takes a first name, last name, or case number. It returns up to 30 records, though not the underlying documents. Family Court needs extra care. A public index or order does not make every pleading and exhibit public. Search with the exact case number when you can. Confirm the court level before requesting a file.
- Read the summons, notice, or case number for the court name.
- Use WVPASS for Circuit Court or MCRSearch for Magistrate Court.
- Choose Mercer County and enter the exact number or party name.
- Review filings, service, motions, settings, orders, and disposition.
- Ask the proper clerk for the exact plain or certified document needed.
Mercer Civil Filings by Category
The West Virginia Judiciary's 2024 annual statistical report counted 815 Mercer Circuit civil filings. The total breaks into 334 general civil cases, 232 mental-health matters, 97 other civil cases, 59 guardianships, 41 adoptions, 27 Magistrate appeals, and 25 personal-safety appeals. Three categories showed no filings that year: administrative appeals, domestic violence, and other domestic relations.
These figures count filings for one year. They do not measure pending cases, public documents, or outcomes. Some categories include records with strong privacy limits. For a current Mercer County civil docket, you still need the court, party, and case number.
What a Mercer Civil Docket Shows
Think of the docket as an event map. It can show the case style, the assigned number and judge, filing date, parties, attorneys, service, answers, motions, hearing notices, continuances, orders, judgment, appeal, costs, and available documents. A short label like "General Civil" does not state the exact claim. The complaint or petition supplies that detail.
| Case Number | The court identifier used in WVPASS, MCRSearch, filings, and clerk requests. |
|---|---|
| Parties | Plaintiff and defendant, or petitioner and respondent, where public. |
| Service | Summons and return events that record notice steps, not a ruling on the claim. |
| Filings | Complaint, answer, petition, motion, exhibit, or other event labels. |
| Settings | Conference, motion, status, trial, or other hearing information where available. |
| Judgment | The entered order that resolves all or part of the matter; read its actual text. |
Mercer Circuit Records Use WVPASS
The official Mercer Circuit Court profile names the Thirteenth Judicial Circuit. It also lists courthouse offices and judges. It identifies Circuit Clerk Julie Ball. WVPASS covers publicly available Circuit cases filed from July 1, 1999 forward. Browsing case details is free. Viewing or downloading a public document costs $0.25 per page plus card processing. The downloaded file is not certified.
That Judiciary page ties Mercer County Circuit Court access to its local court and clerk. The official profile shows that link.
When WVPASS lacks an older file, an image, or a current event, Circuit Clerk Julie Ball's office is the authority. Visit at 1501 Main Street, Suite 111, Princeton, WV 24740, or call 304-487-8323. The clerk can explain public-terminal access and the process for a clerk-certified judgment or order.
Types on Mercer Civil Dockets
Mercer County civil dockets cover more than money disputes. Circuit Court hears general civil and equity matters, claims above Magistrate jurisdiction, extraordinary writs, guardianships, certain mental-health proceedings, and appeals from Magistrate or municipal courts. Annual statistics also track adoption, personal-safety appeals, and other civil categories. Access depends on the type and any governing rule or order. Some matters carry limits.
- General civil, equity, and larger monetary disputes
- Guardianship and adoption matters with applicable limits
- Mental-health-related filings and public orders where allowed
- Magistrate and municipal appeals assigned a Circuit number
- Extraordinary writs and other matters within Circuit jurisdiction
Family Court takes divorce, annulment, separate maintenance, paternity, custody, support, name changes, and related domestic matters. These cases are civil in nature. Their files do not follow the same public-access rules as ordinary Circuit civil litigation.
Mercer Small Claims Take Another Route
Mercer Magistrate Court hears civil claims up to $20,000 under the current Judiciary description. MCRSearch can find a case by name or number. It may show its disposition, but it will not display the complaint or judgment image. For copies, Karmin Richmond's Magistrate Clerk office holds the route. It sits at 120 Scott Street, Suite 103, Princeton, WV 24740. The phone is 304-431-7115.
A Magistrate civil file can hold the complaint, summons, service return, answer, hearing, judgment, payment, execution, and appeal. An appeal creates a Circuit Court record. It gets its own number and is searchable through WVPASS after docketing. Search both levels and cross-reference the appeal entry. Magistrate Administrative Rule 11 sets photocopies at $0.25 per page. Fax service runs $2 per page, subject to the rule.
Hearings on Mercer Civil Dockets
A Mercer County civil docket can list a hearing date in several places: a WVPASS hearing tab, a docket entry, a notice, a scheduling order, or some other filed order. Always read the newest event. A pending case does not guarantee the next date is set. Older dates may have been continued. The Circuit Court posts no stand-alone daily calendar URL.
When a date looks doubtful, confirm it with Julie Ball's office or with the assigned judge's office on the official county court profile. For Magistrate dates, check with Karmin Richmond if MCRSearch is unclear. A continuance, reset, or scheduling order changes procedural history, not the outcome. It does not dismiss the case. The signed order and clerk confirmation control.
| Docket item | What it tells you | What to verify |
|---|---|---|
| Notice of hearing | Planned date, time, place, or type | Whether a later notice changed it |
| Continuance | The event was postponed | The new setting and deadlines |
| Scheduling order | Case deadlines and planned events | Later amendments or court orders |
| Judgment entry | A ruling was entered | Whether it is final and appealable |
Mercer Family Files Stay Different
Mercer County shares the Twelfth Family Court Circuit with McDowell County. The Circuit Clerk holds the local file. Family Court Rule 6 splits the record in two. Orders and indexes are public. The rest stays confidential. Pleadings, exhibits, recordings, transcripts, medical or educational material, child-support information, and other file documents need authorized access.
The hearings themselves are closed under that rule. Parties, their designees, counsel, guardians ad litem, and people with standing may reach parts of the file. The general public cannot. Ask the Circuit Clerk what proof of identity, authorization, or standing is required. A public index only points to a case. It is never permission to obtain the whole file.
Family record boundary: Public orders and indexes do not turn the rest of a Mercer County Family Court file into an open civil record.
Public Access to Mercer Civil Dockets
Mercer County Circuit civil records are open to the public. A statute, court rule, protective order, or access-limitation order can say otherwise. Trial Court Rule 10.03 lets a civil court restrict access by order. That order must state the nature, reason, and duration of the limit. The court can review it later. WVPASS also excludes sealed material. A public case page does not make every attachment public.
Trial Court Rule 10.04 sends requests to the court, clerk, or employee holding the record. It allows reasonable inspection or copies during usual business hours. West Virginia Code §29B-1-3 adds a formal public-record request process. It gives a response framework of up to five days, excluding weekends and legal holidays. That statute does not override a seal, Family Court confidentiality, or any other protection.
Key civil access rules:
Trial Court Rules 10.03, 10.04, and 15A.25-15A.26 govern limits, inspection, and public access to the electronic docket.
Family Court Rule 6 keeps orders and indexes public while protecting most Family Court file material.
W.Va. Code §29B-1-3 requires reasonably specific requests and allows actual reproduction costs.
Mercer Civil Copies and Judgments
A docket entry reading "motion filed" is not the motion itself. "Judgment entered" is not the judgment text either. WVPASS may show the public image for $0.25 per page. Its download is not certified. Check the case and title before you buy. The system does not refund a wrong-case selection. If you need a certified record, that copy must come from the clerk.
For Circuit or Family Court, give Julie Ball the case number. Include the exact title and date, the copy type, the delivery method, and your return contact. West Virginia Code §59-1-11 sets $1 per page for a clerk-made copy used outside the office. An abstract of judgment costs $5. The clerk lists no fixed certification or exemplification surcharge. Ask before paying. For Magistrate records, use Karmin Richmond and the Magistrate fee rules. Confirm mail, fax, electronic delivery, archive retrieval, and confidential-file authorization in advance.
